Client was stopped for driving in the on-coming lane and no license plate light. Client had a “dazed” look on his face and officer spotted a can of beer in the car. Client did poorly on the field sobriety tests. Client tested .178 on the breath alcohol test. Client cited for OVI, Super OVI and No License Plate Light. Client had a reduction of an OVI to Physical Control 1 month prior to this arrest.
A Motion to suppress was filed to dismiss the case.
Prior to the motion hearing, negotiations with the prosecutor resulted in a conviction for Physical Control, 10 days in jail with work release on the last 5 days, $525 fine and a 1 year license suspension.
