Case 1190

Client was observed to be listening to music in the vehicle very loudly at 1:00 am.  The officer followed the vehicle which weaved within its lane and made several lane changes.  Client drove very close the curb and crossed 2 lanes driving close to the centerline. Client ultimately drove over the edge line and was stopped.  Officer detected a slur in client’s speech and bloodshot and glassy eyes.  Client smelled of alcohol and admitted to drinking.  Client failed the field sobriety tests and admitted to being under the influence of alcohol.  Client tested .136 on breath test.  Client cited for 2nd OVI in 6 years and Marked Lanes.  Client had an OVI conviction 1 year earlier.

 

Negotiations with the prosecutor resulted in conviction for 1st OVI in 6 years, a 3-day alcohol school, $375 fine, and a 1 year license suspension.
