Case 1191 OVI

Client was stopped for driving too slowly and driving outside of the marked lanes.  Client’s eyes were glassy and breath smelled of strong odor of alcohol.  Client admitted to consuming alcohol.  Client fail the pen test.  Client failed the one leg stand and walk and turn test, but client told officer that client has a bad back.  Client was cited for OVI and Marked Lanes.  Client refused the breath test.

 

Negotiations with the prosecutor resulted in conviction for Physical Control, a 3-day alcohol school, 20 days in jail suspended, $250 fine, no license suspension, and refusal suspension and reinstatement fee cancelled. 0 points were assessed on the license.
