OVI Reduced To Physical Control

Client was stopped for a faulty license plate.  The officer smelled a strong odor of alcohol and client had bloodshot and glassy eyes.  Client admitted to having one beer.  When client tried to exit his vehicle, the car rolled forward.  Client failed 2 of the sobriety tests.  Client then admitted to consuming 6 beers.  Client tested .092 on the breath test.  Client was cited with OVI and No License Plate Light.  Client had an OVI reduced 3 months earlier.

 

While negotiations were ongoing, client attended a 3-day alcohol school.  A motion hearing was set to challenge the officer’s reason for the stop.  Prior to the motion hearing, the charge was reduced to a Physical Control with a $250 fine, no points and no suspensions.
