Multiple Prior OVI’s

Client was called in by another driver as a reckless driver.  The officer could smell a strong odor of alcohol on client.  Client had a “thick tongue” and slurred speech, and his eyes were bloodshot and glassy.  The officer said that client had trouble walking from his vehicle to the cruiser.  The officer asked client to perform sobriety tests.  Client refused to do any sobriety tests and also refused the breath test.  Client was cited for OVI.  Client had 2 prior OVI’s outside of 6 years.

Negotiations with the State resulted in a negotiated plea to Physical Control with a 3-day alcohol school, $200 fine and 0 points.  The 1 year refusal suspension stayed in effect.
