Case 1230 OVI

Client was stopped for speeding. Client had a strong odor of alcohol and an open Bud Light beer in the vehicle. The client was under 21. Client had a suspended license from an OVI in 2011. Client admitted to drinking beer. The client failed the field sobriety tests. Client was charged with 2nd OVI in 6 years, DUS and Under Age Consumption. Client tested .138 on the alcohol breath test.

 

Client’s concern was the ability to get back and forth to college.

 

Negotiations with the prosecutor resulted in conviction for 1st OVI in 6 years, 3 day alcohol school, 8 month license suspension with school privileges, $675 fine and 0 points assessed on the drivers license. The remainder of the charges were dismissed
