Case 1224 OVI

Police arrived at the scene of client’s auto accident. Client was incoherent when paramedics arrived. Client was transported to the hospital by paramedics. Police talked to client at the hospital. Client smelled of a strong odor of alcohol. Client admitted to driving his car into a ditch. Client admitted to drinking alcohol. Client admitted to drinking 7 beers. Client denied injury. A blood alcohol test revealed a .160 alcohol level. Client was cited with a 3rd OVI offense in 6 years and Failure to Control. Client faced a minimum of 30 days in jail. Client had a prior OVI reduction 3 years earlier.

 

Negations with the prosecutor resulted in a conviction of 2nd OVI in 6 years with 10 days in jail, $525 fine and a 2 year license suspension.
