17 year old client was stopped for driving off the right side of the road. Client had bloodshot glossy eyes and smelled of alcohol. Client admitted to drinking. Client passed some field tests and failed others. Client tested .038 on the breath test. The limit for anyone under 21 is .02. Client cited for Operating Vehicle after Underage Consumption (Kiddie OVI) and Right Side of Roadway. Client placed under Administrative Suspension (which counsel feels was improper.)
Negotiations with the prosecutor resulted in conviction for Reckless Operation with a $100 fine, an alcohol evaluation, 89 license suspension with credit for time previously under suspension, Administrative License Suspension and reinstatement fee cancelled. 4 points were assessed on the license.
