Case 1203 OVI

Client was stopped for not using a turn signal.  Client had a strong odor of alcohol and bloodshot and glassy eyes.  There was also a 12 pack of beer on passenger seat and also a cooler of beer.  Client was 20 years old.  Client admitted to consuming alcohol.  Client received 2 clues on the eye test, 1 clue on the walk and turn test and no clues on the one leg stand.  Client tested .046 on the portable breath test.    Client tested .04 on the regular breath test.  Client was cited for OVI, Operating a Vehicle after Under Age Consumption (kiddie OVI), Under Age Consumption, and No Turn Signal.

 

Client attended an under-age alcohol class prior to plea, and negotiations with the prosecutor resulted in conviction for Reasonable Control with a $150 fine, no license suspension.  2 points were assessed on the drivers license.
