Case 1180 OMVUAC

Client stopped for speeding.  Officer detected odor of alcohol and client’s eyes were bloodshot.  Client tested .04 on the portable breath test. Client failed the pen test, but only received 1 clue each on the walk and turn test and the one leg stand.  Client is 19 years old.  Client took the breath test and tested .035.  Client was cited for OMVUAC (Operating a Vehicle after Under Age Consumption).  Limit for persons under 21 is .020.

 

Client attended a 3-day alcohol school prior to plea, and negotiations with the prosecutor resulted conviction for Reckless Operation, credit for the 3 day school, $250 fine, and no license suspension. 4 points were assessed on the license.
