Client was stopped by officer after he was reported as a drunk driver by a store clerk. Client had a strong odor of alcohol, bloodshot and watery eyes, slurred speech, and was very unsteady on his feet. Client took a partial pen test and refused all other tests. Client refused the breath test. Client had 2 prior OVIs and 2 prior reductions. Clint was cited with 2nd Super OVI in 6 years.

 

Client attended a 3-day alcohol school and counseling prior to plea, and negotiations with the prosecutor resulted conviction for Physical Control with credit for school, $1,000 fine, 90 days in jail suspended, no license suspension, and refusal suspension and reinstatement fee cancelled. 0 points were assessed on the license.
