Underage OVI Reduced to Reckless Operation

Officer was following 18 year old client.  Client went off the right side of the road several times.  While entering a curve, client went over the double yellow line.  After the officer stopped client, client said he was lost.  The officer smelled alcohol on client.  Client admitted to drinking beer.   The officer performed the pen test and got 4 out of 6 clues.  Client’s eyes were bloodshot and glassy.  Client failed the other field tests.  Client was arrested.  Client tested .031 on the breath test.  It is illegal for anyone under 21 to test above .02 on the breath test.  Client was cited for Operating a Vehicle after Underage Age Consumption (kiddie OVI).

 

Negotiations with the State resulted in a reduction to Reckless Operation, $150 fine, 4 points, and an online 8 hour alcohol class.  No license suspension was imposed.
