Officer noticed client making a left hand turn, but completely going off the road and missing the intersection. Client went around the road signs and then got back on the road. The officer initiated a stop. The officer smelled alcohol while talking to client. Client told the officer that he had hurt his lower back earlier in the evening. Client admitted to drinking alcohol. Client failed the field sobriety tests. Client refused the breath test. Client was cited for OVI and Marked Lanes. Client worked for a “high- profile” government agency and was immediately suspended from work.
Fast and furious negotiations ensued. During this time, client obtained an alcohol evaluation, with it indicating there were no alcohol abuse issues. 5 days after client’s arrest, I had client in court, and he pled to Reasonable Control, received no drivers license suspensions, no reinstatement fees, $1,000 fine, and 2 points assessed. The beginning of the next week, client was reinstated in his job.
