OVI and Lanes of Travel

Violation and Citation:

Client was stopped for going left of center as he was pulling out of a parking lot. Client smelled of alcohol and had bloodshot glassy eyes. Client denied drinking and refused all sobriety tests. Client refused the breath test also. Client was arrested and cited with OVI and Lanes of Travel. Client had 2 prior convictions in 2007, and 1 prior conviction in 2007, for OVI. This was Client’s 2nd OVI in 6 years and faced a minimum of 10 days in jail and a 1 year license suspension.

I had client immediately attend a 3-day alcohol school. Negotiations with the state resulted in a conviction for Physical Control, credit for the 3-day school, $1,000 fine, no license suspension imposed, no reinstatement fees, and 0 points assessed.
