Multiple Charges

Client was stopped for doing 81mph in a 55mph zone. The officer smelled the odor of burnt marijuana. The officer found marijuana in the car along with a prescription (indicating not to take and drive). The client admitted to taking the medication recently. During the eye test, the officer indicated that the defendant failed that test and also showed signs of drug impairment. Client failed one other sobriety test, but passed the third test. Client was arrested for OVI, Speed, Driving Under Suspension, Drug Paraphernalia, and Possession of Marijuana. Client’s urine tested positive for marijuana metabolite. This was clients 3rd OVI in 6 years, 4th overall. Client was facing a minimum of 30 days in jail and a license suspension of 2 to 10 years.

 

Client completed an on-line 8 hour alcohol and drug class, and negotiations with the State resulted in a conviction for Physical Control, $500 fine, 0 points assessed, no license suspensions and no reinstatement fees. All other charges were dismissed.
