Could Have Had The Book Thrown At Client

Client was stopped for marked lanes. Client admitted to being on medication (pain killers). Officer found open bottle of Grey Goose Vodka in car. Client could not recite alphabet beyond 3 letters (out of order).While attempting to count backwards, client tries to recite alphabet. Due to client’s inability to comprehend anything, no further sobriety tests were performed. Client refused breath test, but submitted to urine test with a result of .462. Client cited for OVI and Marked Lanes. During pendency of this case, client received conviction for another OVI in another county. Client attended 3-day alcohol school and counseling prior to plea, and negotiations with the prosecutor resulted conviction for low-tier OVI with credit for school, $375 fine and 1 year license suspension.
