Case 1226 Operating A Vessel While Under the Influence and Speeding on a lake

Client was stopped by park rangers on a lake while driving a boat because client was going over the speed limit on the lake at night and client’s boat was not properly illuminated. Client and boat were towed to the nearest public dock and ordered to perform sobriety tests because of the smell of alcohol. Client failed the field sobriety tests. Client did take a urine alcohol test. Client charged with Operating A Vessel While Under the Influence and Speeding on a lake. Case was negotiated prior to the results of the urine alcohol results at the request of the client.

 

Negotiations with the prosecutor resulted in a conviction for Reckless Operation on a boat, with a $250 fine, a 10 hour alcohol class, and no boater’s registration suspension.
