Case 1214 OVI

Client was stopped for speeding.  Client smelled of alcohol and had glassy bloodshot eyes.  Client also had a red flush face and relaxed face muscles (whatever that means).  Client admitted to drinking alcohol and had slurred speech.  Client failed the pen test and the walk and turn test.  Client passed the one leg stand test.  Client refused the breath test.  Client was cited for OVI.  Client has a CDL.

 

Client attended a 3-day alcohol school prior to plea, and negotiations with the prosecutor resulted in conviction for Physical Control with credit for the alcohol school, $1,000 fine, no license suspension, and Administrative License Suspension and reinstatement fee cancelled. 0 points were assessed on the license.
