Case 1195 OVI

Client was stopped for speed.  Officer immediately smelled a strong odor of alcohol, the speech was slurred, and eyes were glassy and blood shot.  Client denied drinking.  Client failed the pen test, incorrectly performed the alphabet and number test, but did well on the walk and turn test and the one leg stand test.  Client refused the breath test.  Client was cited for OVI and Speed.

 

Negotiations with the prosecutor resulted in conviction for Physical Control, a 3-day alcohol school, $200 fine, no license suspension, and refusal suspension and reinstatement fee cancelled. 0 points were assessed on the license.
