Case 1170 OVI

Client was reported to the police as a drunk driver on a motorcycle who was driving close to kids on a sidewalk. The client had difficulty holding the bike upright at stop signs. Client smelled of a strong odor of alcohol when the officer stopped him. Client failed the pen test and refused the other field sobriety tests. Client was searched and had marijuana and a pipe in his pocket. Client tested .231 on a portable breath test. Client refused testing of his blood, breath, or urine. Client was cited for OVI, DUS, Driving under a Refusal Suspension, and Fictitious Plates. Client also cited Possession of Drugs and Possession of Drug Paraphernalia. Client had a pending OVI charge in another jurisdiction. Client also had a prior OVI conviction.

 

Negotiations with the prosecutor resulted in a conviction for OVI and Fictitious Plates with the client serving a 3 day alcohol school, $375 fine and a 6 month license suspension.
