Case 1163 OVI

Client was stopped for urinating on and driving down a closed road.  Client smelled of alcohol and had glassy eyes.  Client performed the pen test, but refused all other tests.  Client refused a breath test.  Client cited for 2nd OVI in 6 years, Driving on a Closed Road and Disorderly Conduct.  Client had prior conviction for OVI 3 years earlier.

 

Negotiations with the prosecutor resulted in a conviction for Physical Control with 55 days in jail suspended, a 3 day alcohol school, $525 fine, 1 year license suspension and the client’s vehicle released from impoundment.  0 points were assessed on client’s license.
