Client was stopped for defective exhaust, but tried to evade the officer.  Client was dragged from his car by the officer.  Client admitted to consuming more than 12 beers.  Client was unable to properly preform the field sobriety tests.  Client tested .153 on the breath test.  Client was cited for OVI, failure to comply, and defective exhaust.  Client was 18 years old.

 

Client attended a 3-day alcohol school prior to plea, and negotiations with the prosecutor resulted conviction for Obstruction Official Business with 10 days in jail suspended and a $750 fine.  Client also convicted of Physical Control with credit for school, $1,000 fine, 10 days in jail suspended, no license suspension, and administrative license suspension and reinstatement fee cancelled.  0 points were assessed on the license.
