Client was alleged to be driving 120mph when he took an off-ramp. Client subsequently totaled his vehicle when he lost control. Once the paramedics released client, the police took over. The officer gave client the field sobriety tests and client failed. Client also blew .092 on the portable breath test. Back at the station, client tested .063 on the breath test. Client admitted to having one beer and taking anti-depressants. Client also stated that he “passed out” a little bit in a fast food parking lot earlier. Client was cited for OVI, Seatbelt, and Failure to Control.
During the time I was negotiating with the State, client successfully completed the 3-day alcohol school. Negotiations resulted in an amended charge of Physical Control with a $100 fine, 0 points, and no license suspensions or reinstatement fees. Remainder of the charges were dismissed.
